An Appication dated 29 October 2024 (Notice dated 8 January 2025) but only made available to SAPRA on 23 January 2025 has been submitted to CoJ for rezoning from Residential 1 to Business 4 along with the removal of restrictions. February 2025: An Objection was submitted on 4th February 2025, the basic concern being that the Application was lodged with the City on 24 October 2024, and advertised from 8 January 2025. The City had issued a notice in terms of the Promotion of Administrative Justice Act, 3 of 2000, that “to advertise any land development applications over the festive period (from 13 December 2024 to 9 January 2025)” would “be considered non-transparent in terms of administrative processes.” This notice, and the subsequent problems experienced in trying to access the Application on the City’s system (and belatedly from the applicant’s agent on 23 January 2025), would indicate the need for re-advertisement or an extension of time within to submit comments/objections and the like. For this reason, the Applicant should be required to re-advertise to give interested and affected parties the chance to consider the Application.

August 2025: Despite SAPRA’s objection, no MPT was held, which is contrary to the by-law requirements. Building operations are underway, but it has been reported that they are minor at the moment. Should the objection, and the disregarding of it, be pursued?
