Updated information about this application and SAPRA's involvement.

SAPRA achieved a great deal in its objection to the rezoning application of 37 Wantage Road, Parkwood (Erf 5760). Although the application for Business 4 was approved by the City of Johannesburg, there are significant reductions in the rights attached to a Business 4 zoning, which would not have been taken into account otherwise.

The rights granted are:

  1. to allow offices only
  2. reduce the height to one storey, 
  3. reduce the floor area and the coverage, 
  4. retain the restriction of the sale of liquor in the title deed (Condition (b))

Amendment of condition (b) of Deed of Transfer T021764/07 to read 'The owner of the said Lot shall not have the right to open or allow or cause to be opened thereon any canteen, hotel, restaurant, or any other place for the sale of wines, beer or spirituous liquor'.

We have been advised that an appeal is unlikely to achieve anything better, as the Appeal Tribunal will be advised by the Chairperson’s report on the hearing, and the Tribunal members input (which is generally aligned to the Nodal Development Zone guidelines which are perceived to be supportive of the application).
